In real estate transactions most of the risk arises before the title is transferred. A zoning irregularity or annotation discovered after transfer is usually difficult to reverse.

Pre-purchase checklist
- Title records: liens, mortgages, annotations and declarations.
- Zoning status: conformity of the building with its permit and project; the scope of any building registration certificate.
- Condominium ownership or floor easement: which is established, and if incomplete, why.
- Common areas and appurtenances: how parking spaces and storage appear on the title.
- Tax and management dues: obligations attached to the property.
Updating the rent
On renewal, any increase may not exceed the twelve-month average change in the consumer price index for the preceding rental year (Code of Obligations Art. 344). Where the lease has run for more than five years, the court may determine an equitable rent taking the index, the condition of the property and comparable rents together into account.

Frequently Asked Questions
- Is there a right of withdrawal in off-plan housing purchases?
- A consumer may withdraw within fourteen days of the conclusion of the contract without giving any reason and without paying a penalty (Consumer Protection Law No. 6502, Art. 43). The seller must also provide a building completion insurance policy or another prescribed form of security until delivery.
- When can a rent determination claim be filed?
- It must be filed at least thirty days before the start of the new rental period, or the landlord must notify the intention to increase in writing within that period. Otherwise the rent determined applies from the following rental period.
- How much property can a foreign national acquire in Türkiye?
- A foreign natural person may acquire a maximum of thirty hectares nationwide. In addition, acquisitions within any district may not exceed ten per cent of the privately owned land in that district (Land Registry Law Art. 35). The property must also not fall within a military prohibited zone.
